MAGISTRATES COURT (CIVIL PROCEEDINGS) ACT 2004 - SECT 24
24 . Experts, use of
(1) The Court, with or
without the consent of the parties, may refer a question arising in a case to
a person who is an expert in the relevant field for investigation and a
report.
(2) The expert has and
may exercise any powers of the Court that are delegated to experts by rules of
court for the purposes of this section.
(3) The Court may
adopt all or some of the expert’s report.
(4) The cost of the
expert’s investigation and report is to be paid by the parties in equal
shares unless the Court orders, or the parties agree, otherwise.
(5) The
Magistrates Court Act 2004 section 37 applies to an expert in respect of his
or her performance or purported performance of the functions of an expert
under this section.
