MAGISTRATES COURT (CIVIL PROCEEDINGS) ACT 2004 - SECT 12
12 . Pre-judgment interest may be awarded
(1) If the Court gives
judgment in favour of a claim for money, including a debt, damages or the
value of goods, it may include in the judgment sum either —
(a)
interest, at a rate decided by the Court, on the whole or a part of the money
for the whole or a part of the period that —
(i)
begins on the date when the cause of action arose; and
(ii)
ends on the date when the judgment is given;
or
(b) a
lump sum of money in lieu of such interest.
(2) Subsection (1)
does not —
(a)
authorise the giving of interest on interest; or
(b)
apply in relation to any general damages in respect of pain and suffering or
the loss of enjoyment or of the amenities of life awarded in relation to
personal injury (including any disease or impairment of a person’s
physical or mental condition) or the death of a person; or
(c)
apply in relation to any debt upon which interest is payable as of right
whether by virtue of any agreement or otherwise; or
(d)
affect the damages recoverable for the dishonour of a bill of exchange.
