MAGISTRATES COURT ACT 2004 - SECT 40
40 . Rules of court: content
(1) The rules of court
may deal with any matter —
(a) that
is required or permitted by this Act to be dealt with by rules of court; or
(b) that
is necessary or expedient for the Court to operate efficiently, economically
and expeditiously.
(2) Without limiting
subsection (1) the rules of court may —
(a)
regulate the custody and use of the Court’s seals;
(b)
regulate in which of the Court’s registries cases are to be commenced,
conducted or dealt with;
(c)
regulate the practice and procedure to be followed in the Court and its
registries;
(d)
provide for documents to be lodged with or issued by the Court, or served, in
an electronic form.
(3) The rules of court
must not be inconsistent with —
(a) this
Act; or
(b) the
Criminal Procedure Act 2004 ; or
(c) the
Magistrates Court (Civil Proceedings) Act 2004 ; or
(d) any
other Act that confers jurisdiction on the Court; or
(e) any
other Act that regulates the procedure in the Court; or
(f)
regulations made under those Acts.
