MINING ACT 1978 - SECT 106
106 . Offence of destroying marks or obstructing surveyor etc.
A person who —
(a)
without lawful authority removes, destroys or alters the position of, any peg,
notice, survey peg, mark, post, cairn of stones or pole used for the purposes
of any marking out or survey made or being made under section 104; or
(b)
wilfully damages, destroys or otherwise interferes with any peg, survey peg,
mark, post, cairn of stones, pole erected or notice posted for the purposes of
this Act; or
(c)
wilfully obstructs, hinders, or interferes with any person lawfully engaged in
marking out or surveying any land under that section,
is guilty of an
offence against this Act.
