Western Australian Consolidated Acts (1) An employee shall
not, during any period when he is on long service leave, engage in any
employment for reward in substitution for the employment from which he is on
leave.
(2) If an employee,
during any period when he is on long service leave, engages in any employment
for reward in substitution for the employment from which he is on leave the
employee shall thereupon forfeit his right to leave hereunder in respect of
the unexpired period of leave upon which he has entered, and the employer
shall be entitled to withhold any further payment in respect of the period and
to reclaim any payments already made on account of such period of leave.
(3) The provisions of
this section shall not apply to an employee who, pursuant to
section 9(2), is deemed to commence a period of leave on the day of the
termination of his employment.
