Western Australian Consolidated Acts (1) A reference in
this Act to a conviction includes a finding of guilt, or the acceptance of a
guilty plea, whether or not a conviction is recorded.
(2) Without limiting
subsection (1), a reference in this Act to the quashing of a conviction
for an offence includes a reference to the quashing of —
(a) a
finding of guilt in relation to the offence; or
(b) the
acceptance of a guilty plea in relation to the offence.
(3) However, a
reference in this Act to the quashing of a conviction for an offence does not
include a reference to the quashing of a conviction where —
(a) a
finding of guilt in relation to the offence; or
(b) the
acceptance of a guilty plea in relation to the offence,
remains unaffected.
(4) A conviction
includes a conviction before the commencement of this section.
