Western Australian Consolidated Acts The building owner, in
addition to and without prejudice to rights, if any, which he has irrespective
of this Division, has a right to cut away or take down such parts of a wall or
building of an adjoining owner, as is necessary, in consequence of that wall
or building overhanging or encroaching upon the ground of the building owner,
in order to erect an upright wall against it, on condition of making good
damage sustained by the wall or building by reason of the cutting away or
taking down.
