9.18 . Notice placing onus on vehicle owner
(1) If the alleged
offence is one for which a notice under section 9.13 can be given to the owner
of a vehicle involved in the commission of the offence, that notice can be
included in the same document as an infringement notice to the owner for the
alleged offence.
(2) For the purpose of
giving the vehicle owner an infringement notice that is with a notice under
section 9.13 —
(a) it
is a sufficient ground for believing the owner to have committed the alleged
offence that the person is the owner; and
(b) the
infringement notice may be addressed and given as specified in
section 9.13(4).
(3) Where the modified
penalty specified in an infringement notice has been paid within 28 days or
such further time as is allowed, section 9.13(6) does not have effect to deem
the owner to have committed the offence.
(4) The statement
required by section 9.13(5) is to include a description of the effect of
subsection (3) if an infringement notice is given with a notice under
section 9.13.
