LOCAL GOVERNMENT ACT 1995 - SECT 6.58
6.58 . Defence in special cases
If a person sued or
proceeded against proves that a notice required to be given under Subdivision
3 has not been given, the claim of the local government does not on that
account fail, but such objections as would have been competent on an
application under Subdivision 7 for a review may be raised as a defence to the
whole or part of the claim, unless they have already been unsuccessfully
raised by the person on an application under that Subdivision for a review.
