2.38 . Function of commissioner
(1) The function of a
commissioner of a local government is to exercise the powers and discharge the
duties of the council of the local government and its mayor or president.
(2) A commissioner is
to be regarded as being the council.
(3) Unless
section 2.43 applies, or the contrary intention appears, a reference in this
Act or another written law to a local government, a council or a member of a
council includes reference to a commissioner.
