LOCAL GOVERNMENT ACT 1995 - SECT 2.33

2.33 .         Extraordinary vacancy on election to a parliament

        (1)         If a member of a council is elected as a member of a parliament (as defined in section 2.20) the office of the member as an elector mayor or president or as a councillor becomes vacant on the next ordinary elections day.

        (2)         Subsection (1) does not have effect if — 

            (a)         the member’s term of office ends under the Table to section 2.28; or

            (b)         the member’s office becomes vacant under section 2.32,

                on or before the next ordinary elections day.
