LOCAL GOVERNMENT ACT 1995 - SECT 2.17
2.17 . Members of council where mayor or president elected by electors
(1) If the method of
filling the office of mayor or president is election by electors, the council
is to consist of —
(a) the
mayor or president; and
(b) a
number of councillors that is —
(i)
not less than the minimum number of councillors under
subsection (3); but
(ii)
not more than the maximum number of councillors under
subsection (4).
Note for this paragraph:
For the council of the
City of Perth, the number of councillors is 8 — see the City of Perth
Act 2016 section 9.
(2) One of the
councillors is to hold the office of deputy mayor or deputy president in
conjunction with their office as a councillor.
(3) For the purposes
of subsection (1)(b)(i), the minimum number of councillors is as follows
—
(a) if
the district’s population is not more than 75 000 — 4 councillors;
(b)
otherwise — 8 councillors.
(4) For the purposes
of subsection (1)(b)(ii), the maximum number of councillors is as follows
—
(a) if
the district’s population is not more than 5 000 — 6 councillors;
(b) if
the district’s population is more than 5 000 but not more than 75 000
— 8 councillors;
(c)
otherwise — 14 councillors.
