Western Australian Consolidated Acts (1) Any proceedings
instituted before a court —
(a) for
the recovery of any amount due to or recoverable by the Commission under this
Act; or
(b) for
any offence against this Act or the rules,
may be instituted by
the Director or by a member of the staff authorised by the Director to
institute proceedings on behalf of the Commission.
(2) A person referred
to in subsection (1) may appear on behalf of the Commission in any
proceeding referred to in that subsection.
(3) In any proceeding
referred to in subsection (1), no proof shall be required, until evidence
is given to the contrary, of —
(a) the
constitution of the Commission;
(b) the
authority of any member of the staff to institute or appear in that
proceeding; or
(c) the
appointment of the Director or any member of the staff.
