LAND ADMINISTRATION ACT 1997 - SECT 57
57 . Leases in relation to roads
(1) The Minister may
—
(a)
grant a lease in respect of land above or below a road; or
(b) with
the consent of the relevant local government, the Commissioner of Main Roads,
or the Minister responsible for the administration of the Public Works Act
1902 , as the case requires, grant a lease in respect of land comprising a
road, if —
(i)
there are structures above the road; or
(ii)
the purpose of that lease is consistent with the use of
the road by the public.
(2) When a lease is
granted under subsection (1)(b) in respect of land comprising a road and the
road is closed under section 58 during the subsistence of the lease, the lease
continues to subsist as an interest in Crown land until it terminates in
accordance with law.
