fee simple in Crown land is transferred under this Act subject to
encumbrances, it is declared that sections 81Q, 81R, and 81RA (in respect
of a transfer effected on or after the coming into operation of the
Land Administration Act 1997 ) of the TLA apply to that land whether or
not there is a specific provision in the TLA or this Act that provides for
encumbrances to be transferred to, and applied to, the fee simple when
transferred in all respects as if the fee simple had been referred to in the
encumbrance.
