LIMITATION ACT 2005 - SECT 53
53 . Limitation period in case of death of certain persons if cause of action accrues to certain other persons
(1) In this section
—
person A means —
(a) a
person who is under 18 years of age when a cause of action accrues to the
person and who dies without having reached 18 years of age; or
(b) a
person who, at any time after a cause of action accrues to the person, is
suffering a mental disability and who dies at a time when the person is
suffering the mental disability.
(2) If, on person
A’s death, person A’s cause of action accrues to a person ( person
B ) who is either under 18 years of age or suffering a mental disability when
person A dies, a further extension of time is not allowed by reason of person
B’s being under 18 years of age or suffering a mental disability.
