LIMITATION ACT 2005 - SECT 32
32 . Suspension of time while person under 18 is without guardian
(1) If —
(a) a
person is under 18 years of age when a cause of action accrues to the person;
and
(b)
during any time after the accrual but before the person reaches 18 years of
age the person is without a guardian,
the time during which
the person is without a guardian does not count in the reckoning of the
limitation period for commencing an action on the cause of action.
(2) Despite subsection
(1), an action on the cause of action cannot be commenced —
(a) if
the person has reached 21 years of age; or
(b) in
the case where Part 2 Division 2 or 3 provides for a longer limitation period
for commencing the action, if that limitation period has expired.
(3) This section is
subject to section 33.
