action as is referred to in section 38(1) has accrued against 2 or more
joint debtors, the person having such cause of action shall not be entitled to
any additional time within which to sue one or more of such joint debtors who
was or were not beyond the seas by reason only that some one or more of such
joint debtors was or were at such time beyond the seas; and such person so
entitled shall not be barred from commencing against one or more of such
last-mentioned joint debtors after his or their return from beyond the seas by
reason only that judgment has already been recovered against one or more of
such first-mentioned joint debtors.
