Western Australian Consolidated Acts (1) The Commission may
make a code of good faith to provide guidance about the application of the
duty of good faith under section 42B in relation to bargaining for an
industrial agreement —
(a)
generally; or
(b) in
relation to particular types of situations.
(2) The code shall not
be inconsistent with this Division.
(3)
Section 43(7), (8) and (9) of the Interpretation Act 1984 apply to
the code as if it were subsidiary legislation.
(4) The Commission may
amend or revoke the code or revoke it and substitute another code for it.
(5) The Commission
shall cause the code, and any amendment or substituted code or any revocation
of a code, to be published in the Industrial Gazette for public information.
(6) In this
section —
Commission means the Commission in Court Session.
