Western Australian Consolidated Acts (1) An award has
effect according to its terms, but unless and to the extent that those terms
expressly provide otherwise it shall, subject to this
section —
(a)
extend to and bind —
(i)
all employees employed in any calling mentioned therein
in the industry or industries to which the award applies; and
(ii)
all employers employing those employees;
and
(b)
operate throughout the State, other than in the areas to which
section 3(1) applies.

(4) An award, and any
provision of an award, whether or not it has been made for a specified term,
shall, subject to any variation made under this Act, remain in force until
cancelled, suspended, or replaced under this Act unless, in the case of an
award or a provision made for a specified term, it is expressly provided that
the award or the provision, as the case may be, shall cease to operate upon
the expiration of that term.
(5)
Subsection (4) does not prevent the cancellation, suspension, or
replacement of an award in part.
