Western Australian Consolidated Acts (1) Subject to this
section, the decision of the Commission, except a direction, order or
declaration under section 32 or an order for dismissal shall, before it
is delivered, be drawn up in the form of minutes which shall be handed down to
the parties concerned and, unless in any particular case the Commission
otherwise determines, its reasons for decision shall be published at the same
time.
(2) At the discretion
of the commissioner giving the decision the minutes and reasons for decision
may be handed down by the Registrar.
(3) The parties
concerned shall, at a time fixed by the Commission, be entitled to speak to
matters contained in the minutes of the decision and the Commission may, after
hearing the parties, vary the terms of those minutes before they are delivered
as the decision of the Commission.
(4) The Commission,
with the consent of the parties, may waive the requirements of this section in
any case in which it is of the opinion that the procedures therein prescribed
are inappropriate or unnecessary.
