Western Australian Consolidated Acts (1) The Commission has
jurisdiction to determine in any proceedings before it whether any matter to
which those proceedings relate is an industrial matter and a finding by the
Commission on that question is, subject to sections 49 and 90, final and
conclusive with respect to those proceedings.
(2)
A determination under subsection (1) is not a decision for the
purposes of section 49 or 90 unless and until —
(a)
those proceedings have been concluded; or
(b)
leave to appeal is granted by the Commission making that determination.
