Western Australian Consolidated Acts (1) If a registration
board or a committee established by a registration board, in the performance
of its functions, receives a complaint that comes within section 25, not
being a complaint referred to it under section 31 or 43(3), the board or
the committee must give a copy of the complaint to the Director.
(2) Where a copy of a
complaint is given to the Director under subsection (1) or by a
registration board under an Act mentioned in Schedule 1, the Director may
determine that the complaint is to be treated as one that was made under this
Act if —
(a) the
board and the Director agree that the complaint is suitable for conciliation
under this Act; and
(b) the
person who made the complaint consents in writing.
(3) The fact that
the Director makes a determination under subsection (2) does not prevent
the board or the committee from performing its functions in respect of the
complaint.
