HUMAN REPRODUCTIVE TECHNOLOGY ACT 1991 - SECT 32
32 . Terms, conditions and directions specifically applicable
(1) Without derogating
from the generality of the discretion conferred on the CEO, the CEO may impose
terms, conditions or directions which it considers desirable in order to
—
(a)
ensure that the safety, health or welfare of persons is not at risk; or
(b)
regulate the kind of practice and procedure, or any project of research,
authorised and the manner in which it shall be carried out; or
(c)
limit the authority conferred under a licence or exemption; or
(d)
require action therein specified to be undertaken by the holder —
(i)
within a time or at times therein specified; or
(ii)
on occasions or in circumstances therein specified,
in relation to the
premises to which the licence or exemption relates, the conduct of the
reproductive technology practice carried on, or otherwise in the public
interest; or
(e)
prevent improper arrangements or practices; or
(f)
ensure compliance with the requirements of, or with terms fixed, conditions
imposed or directions given, under this Act.
(2) A term or
condition applicable to a licence or exemption, other than a term or condition
imposed specifically by Part 3, this Part or the regulations, may be varied or
cancelled, or may be imposed subsequent to the grant of the licence or the
issue of the exemption, at discretion by the CEO if evidenced —
(a) by a
notice in writing setting out particulars of the term or condition concerned
(which may be a reference to the Rules or directions) and served on the
licensee; or
(b) by
being endorsed on the licence or exemption or being included, or so referred
to, in a revised version,
as the CEO may
require, but no such term or condition shall have effect in so far as it may
be inconsistent with the Rules for the time being.
(3) The CEO at any
time may, on the application of the licensee or the licence supervisor, vary
the terms of, or revoke, a licence or any condition other than a condition
imposed by section 33.
