HUMAN REPRODUCTIVE TECHNOLOGY ACT 1991 - SECT 19
19 . Principles to be embodied in Code
(1) The Council in
compiling the Code of Practice shall have regard to the principles set out in
section 17 and sections 22, 23, 24, 25 and 26.
(2) Until the
principles referred to in subsection (1) are embodied in the Code —
(a)
where any of those principles is specifically referred to in directions given
for the purposes of this Act, a failure to give effect to it on the part of a
licensee may for the purposes of sections 14(3), 29(5)(a) and 39(2)(b) be
taken to be a contravention of a requirement under this Act; and
(b)
otherwise, in so far as any of those principles is relevant to the conduct of
a practice or any procedure —
(i)
effect shall be given to the principle by all persons to
whom this Act applies; and
(ii)
on any application or in disciplinary proceedings, the
manner of observance of any such principle is a matter which the CEO and the
State Administrative Tribunal may take into account.
