Western Australian Consolidated Acts (1) Prosecutions for
offences against this Act —
(a) may
be instituted by the Registrar of the Builders’ Registration Board
appointed under the Builders’ Registration Act 1939 or a person
authorised by that Board to do so, and may not be instituted by any other
person;
(b) may
be commenced within 3 years after the alleged commission of the offence.
(2) A statement in a
prosecution notice that a person is the Registrar of the Builders’
Registration Board or is authorised by that Board under subsection (1)(a)
is to be taken as proved in the absence of evidence to the contrary.
