cover is provided by an approved fund in relation to residential building work
performed by a builder if the person for whom the residential building work is
performed, and that person’s successors in title, are in the same
position that they would be if a policy of insurance that complies with this
Division were in force in relation to the residential building work.
(2) Any discretion
that a person has to approve a claim on the fund is to be disregarded for the
purposes of subsection (1).
