Western Australian Consolidated Acts (1) In every
proceeding under this Act with respect to any drug, the standard settled and
appointed by regulations under this Act shall be the standard, or if no such
standard shall have been settled and appointed in respect of any drug, the
pharmacopoeia as defined by The British Pharmacopoeia shall be taken as the
standard.
(2) A purchaser of a
drug for which a standard referred to in subsection (1) exists shall, in
the absence of proof to the contrary, be deemed to have demanded the standard
quality of that drug.
(3) A drug for which a
standard referred to in subsection (1) exists shall, for the purposes of
this Act, be deemed to be pure if it is in conformity with that standard.
