Western Australian Consolidated Acts (1) A person
shall not, in trade or commerce, provide any materially inaccurate information
in respect of any goods, services, or interest in land.
(2) Where a product
information standard has been prescribed assigning a meaning to information of
a specified kind in respect of any specified goods or services or class of
goods or services, any such information shall, for the purposes of this
section, be deemed to be materially inaccurate if it is in that respect
inaccurate to any degree in terms of the meaning so assigned.
(3) Alteration or
variation by whatever means of any information already provided constitutes
the provision of materially inaccurate information if the information as a
result of the alteration or variation is materially inaccurate.
(4) Where an act or
omission by a person is an offence against this section and is also an offence
against section 12 and a person is convicted of the offence, the person
is not liable to be punished twice in respect of the same act or omission.
