Western Australian Consolidated Acts (1) Where there is a
contract for the supply (otherwise than by way of sale by auction) by a person
in the course of a business of goods to a consumer by description, there is an
implied condition that the goods will correspond with the description, and, if
the supply is by reference to a sample as well as by description, it is not
sufficient that the bulk of the goods corresponds with the sample if the goods
do not also correspond with the description.
(2) A supply of goods
is not prevented from being a supply by description for the purposes of
subsection (1) by reason only that, being exposed for sale or hire, they
are selected by the consumer.
