Western Australian Consolidated Acts (1) A person shall
not, in relation to employment that is to be, or may be, offered by the person
or by another person, engage in conduct that is liable to mislead persons
seeking the employment as to the availability, nature, terms or conditions of,
or any other matter relating to, the employment.
(2) For the purposes
of subsection (1) the engagement, or possible engagement, of a
person —
(a) on
the basis of a commission or a selling contract;
(b) on a
principal and agent relationship; or
(c) as
an independent contractor, distributor or holder of a franchise,
relating to the supply
on behalf of another person of goods or services or an interest in land may be
taken to constitute employment.
