Western Australian Consolidated Acts Section 90 does
not apply to or in relation to any person by reason only of the
person —
(a)
keeping, breeding, hatching, culturing or selling any fish of a prescribed
class, for a prescribed purpose or in a prescribed area;
(b)
keeping any fish at a place specified in a fish processor’s licence
under section 83(2) for the purpose of processing the fish in accordance
with the licence;
(c)
keeping any fish in or on any premises for the purpose of serving the fish as
meals to the public, or otherwise for the purpose of consumption, in or on
those premises; or
(d)
selling any fish of a prescribed class in, or taken from, a dam or lake on
private land in a prescribed area if —
(i)
the person is the owner or occupier of the land; and
(ii)
the fish are sold to a person who is authorised by an
aquaculture licence to purchase the fish.
