FISH RESOURCES MANAGEMENT ACT 1994 - SECT 77
77 . Contravening condition of managed fishery licence or managed fishery permit, offence
(1) A person must not
intentionally or recklessly contravene a condition of —
(a) a
managed fishery licence; or
(b) a
managed fishery permit.
Penalty:
(a) for
an individual —
(i)
for a first offence, a fine of $40 000;
(ii)
for a second or subsequent offence, a fine of $80 000 and
imprisonment for 3 years;
(b) for
a body corporate —
(i)
for a first offence, a fine of $80 000;
(ii)
for a second or subsequent offence, a fine of $150 000.
(2) A person must not
contravene a condition of —
(a) a
managed fishery licence; or
(b) a
managed fishery permit.
Penalty:
(a) for
an individual, a fine of $15 000;
(b) for
a body corporate, a fine of $30 000.
(3) A person charged
with an offence under subsection (1) may be convicted of an offence under
subsection (2) if that offence is established by the evidence.
