Western Australian Consolidated Acts (1) The general
penalty for a contravention of section 74 is —
(a) if
the provision of the management plan that is contravened is designated in the
plan as a major provision —
(i)
for a first offence against that section, in the case of
an individual, to a fine not exceeding $25 000 and imprisonment for
1 year or, in the case of a body corporate, to a fine not exceeding
$50 000; or
(ii)
for a second or subsequent offence against that section,
in the case of an individual, to a fine not exceeding $50 000 and
imprisonment for 2 years or, in the case of a body corporate, to a fine
not exceeding $100 000;
(b) in
any other case —
(i)
for a first offence against that section, in the case of
an individual, to a fine not exceeding $10 000 or, in the case of a body
corporate, to a fine not exceeding $20 000; or
(ii)
for a second or subsequent offence against that section,
in the case of an individual, to a fine not exceeding $20 000 or, in the
case of a body corporate, to a fine not exceeding $40 000.
(2) A provision may be
designated in a management plan as a major provision for the purposes of this
section by reference to the circumstances in which the provision is
contravened.
