FISH RESOURCES MANAGEMENT ACT 1994 - SECT 107
107 . Destroying noxious fish, recovering costs of
(1) If —
(a) a
person refuses or fails to comply with a requirement made under
section 106(1); and
(b) as a
result of that refusal or failure it is necessary for a fisheries officer to
seize and destroy or otherwise dispose of any noxious fish that are the
subject of the requirement,
any costs or expenses
reasonably incurred by the fisheries officer in seizing and destroying or
otherwise disposing of the fish may be recovered from that person as a debt
due to the CEO in any court of competent jurisdiction.
(2) Subsection (1)
applies whether or not the person liable to pay the costs or expenses has been
proceeded against and convicted of an offence under section 106(2).
