FREEDOM OF INFORMATION ACT 1992 - SECT 81
81 . Disclosure restriction under other law does not apply to disclosing to Commissioner; privileges of parties
(1) No obligation to
maintain secrecy or other restriction on the disclosure of information
obtained by or given to agencies, whether imposed under an enactment or other
law, applies to the disclosure of information to the Commissioner for the
purposes of Division 3.
(2) Legal professional
privilege does not apply to the production of documents or the giving of
evidence by an agency, or an officer of an agency, to the Commissioner for the
purposes of Division 3.
(3) Subject to
subsections (1) and (2), every party to a complaint has the same privileges in
relation to the giving of evidence and the production of documents and things
that he or she would have as a witness in proceedings before a court.
