Western Australian Consolidated Acts (1) If the Treasurer
is satisfied that it is appropriate to do so because of special circumstances,
the Treasurer may authorise an amount to be paid to a person even though the
payment would not otherwise be authorised by law or required to meet a legal
liability.
(2) The Treasurer
cannot authorise the payment under this section of an amount that exceeds the
amount prescribed by the regulations for the purposes of this subsection
unless that payment is approved by the Governor.
(3) A payment under
this section may be made subject to conditions and, if any such condition is
breached, the amount paid may be recovered as a debt due to the State in a
court of competent jurisdiction.
(4) A request or
recommendation to make a payment under this section may be made to the
Treasurer in accordance with the Treasurer’s instructions.
