FAMILY COURT ACT 1997 - SECT 39
39 . Non-federal jurisdictions of courts of summary jurisdiction
Subject to Division 4
—
(a) the
Magistrates Court, constituted by a magistrate, sitting at a place outside the
metropolitan region; and
(b) the
Magistrates Court, constituted by a family law magistrate, sitting at any
place in the State,
may exercise all the
non-federal jurisdictions of the Family Court of Western Australia except the
functions of the Court under the Adoption Act 1994 or the Surrogacy Act 2008
and, in exercising such jurisdiction, the court must have regard to the
principles and matters set out in section 37, where applicable.
