FAMILY COURT ACT 1997 - SECT 205ZPA
205ZPA . Financial agreement may include agreement that deals with superannuation
(1) A financial
agreement may include an agreement that deals with superannuation interests
(as defined in the Family Law Act section 90YD) of either or both of the
parties to the financial agreement as if those interests were property.
(2) For the purposes
of subsection (1), it does not matter whether or not the superannuation
interests are in existence at the time the agreement is made.
Note for this section:
The Family Law Act
section 90YK(3) provides that the part of the financial agreement that deals
with superannuation interests has effect only in accordance with the
Family Law Act Part VIIIC. In particular, it cannot be enforced under this
Act.
