FOOD ACT 2008 - SECT 131
131 . Onus to prove certain matters on accused person
(1) In any proceedings
for an offence under this Act against an accused person who was responsible
for making a false statement on a package or in an advertisement relating to
the origin or composition of the food in question or the therapeutic or
nutritive properties of the food, the onus of proving the correctness of the
statement is on the accused person.
(2) In subsection (1)

false statement means a statement that is alleged
to have caused the food to be falsely described.
