FOOD ACT 2008 - SECT 107
107 . Notification of conduct of food businesses
(1) The proprietor of
a food business must not conduct the food business at any premises unless the
proprietor has given written notification in respect of those premises to the
appropriate enforcement agency, in the approved form, of the specified
information.
Penalty:
(a) for
an individual — a fine of $10 000;
(b) for
a body corporate — a fine of $50 000.
(2) In subsection (1)
—
specified information means the information
specified in the Food Safety Standards that is to be notified to the
appropriate enforcement agency before the food business is conducted.
(3) Subject to
subsection (4), the notification must be accompanied by the fee, if any,
prescribed by the regulations.
(4) If the appropriate
enforcement agency is a local government —
(a) any
fee prescribed by the regulations for the purposes of subsection (3) does not
apply to notification given to the agency under this section; and
(b) the
fee for notification given to the agency under this section may be imposed and
recovered by the agency under the Local Government Act 1995 Part 6 Division 5
Subdivision 2.
