ENVIRONMENTAL PROTECTION ACT 1986 - SECT 92A
92A . Seizing evidence etc.
(1) An inspector may
seize any thing that the inspector suspects on reasonable grounds —
(a) is,
or is intended to be, involved in the commission of an offence against this
Act; or
(b) may
afford evidence of the commission of such an offence.
(2) As soon as
practicable after the thing is seized, the inspector is to give a receipt for
it to the person from whom it was seized.
(3) If for any reason,
it is not practicable to comply with subsection (2), the inspector is to
—
(a)
leave the receipt at the place of seizure; and
(b)
ensure the receipt is left in a reasonably secure way and in a conspicuous
position.
(4) Nothing in this
section restricts the power of an authorised person or police officer to seize
equipment under section 81A.
