Western Australian Consolidated Acts (1) The Authority
may, by instrument in writing, approve a scheme that provides for a person
(the electricity ombudsman ) to investigate and deal with —
(a)
disputes and complaints under customer contracts;
(b)
disputes between —
(i)
customers and licensees; or
(ii)
customers and electricity marketing agents;
(c)
complaints by customers about —
(i)
licensees; or
(ii)
electricity marketing agents;
and
(d) any
other kind of dispute or complaint (whether or not under a customer contract)
that is prescribed by the regulations.
(2) A scheme may treat
a failure to make a decision within a specified period as a decision of a
particular kind.
(3) A scheme may be
made applicable to a dispute or complaint that arose before the commencement
of the scheme, but not earlier than 12 months before that commencement.
(4) The Authority may,
by instrument in writing, approve an amendment to an approved scheme.
(5) Notice of an
approval under subsection (1) is to be published in the Gazette .
(6) In the case of the
initial electricity ombudsman scheme, this section has effect subject to
Schedule 3 clause 4.
