43 . Uniform charges and zoning
(1) The Coordinator
may create zones in any district which is supplied or which it is proposed to
supply with electricity by a supply authority, and may from time to time alter
the boundaries of such zones.
(2) A supply authority
shall not make against any person for the supply to him of electricity any
charge which exceeds the standard charge made by such supply authority against
all other persons in the same zone for electricity supplied to them for the
same use or purpose as that for which the first mentioned person desires to
obtain a supply of electricity.
Penalty: $500.
(3) Any supply
authority which acts in contravention of subsection (2) shall, in addition to
its liability under that subsection, be liable to repay on demand to the
person against whom the overcharge has been made the amount of the excess
overcharged; and if such repayment is not paid when demanded the person
entitled to such repayment shall be entitled to recover the same as and for a
debt owing to him by action against the supply authority in any court of
competent jurisdiction.
