ELECTORAL ACT 1907 - SECT 76A
76A . Who is qualified to be elected as member of Parliament
(1) Unless this Act or
another enactment provides otherwise, a person who —
(a) has
reached the age of 18; and
(b) is
not subject to any legal incapacity; and
(c) is
an Australian citizen; and
(d) has
resided in the State for one year; and
(e) is
an elector entitled to vote at an election in a district,
is qualified to be
elected as a member of the Council or the Assembly.
(2) The reference in
subsection (1)(e) to an elector entitled to vote at an election in a district
includes a reference to a person if —
(a) the
person is qualified to be an elector entitled to vote at an election in a
district; and
(b) the
person’s name appeared on a roll or the person has made a claim for
enrolment; and
(c) by
mistake, the Electoral Commissioner or an enrolment officer has omitted or
removed the person’s name from a roll or has not included the
person’s name on a roll.
