COMMERCIAL TENANCY (RETAIL SHOPS) AGREEMENTS ACT 1985 - SECT 15E
15E . Conduct that is not unconscionable for s. 15C and 15D
A person is not to be
taken for the purposes of section 15C or 15D to engage in unconscionable
conduct in connection with a retail shop lease only because —
(a) the
person institutes legal proceedings in relation to the lease or refers a
dispute or claim in relation to the lease to arbitration; or
(b) the
person fails to renew the lease or enter into a new lease; or
(c) the
person does not agree to having an independent valuation of current market
rent carried out.
