CONTAMINATED SITES ACT 2003 - SECT 24
24 . Who is responsible for remediation — hierarchy of responsibility
(1) A person is
responsible for remediation of a site —
(a) in
accordance with section 25, if the person has caused, or contributed to, the
contamination of the site;
(b) in
accordance with section 26, if the person is an owner or occupier of the site
who has changed, or proposes to change, the use to which land that comprises
all, or part, of the site is put; and
(c) in
accordance with section 27, if the person is an owner of the site, or of a
source site.
(2) Subsection (1) has
effect subject to —
(a)
section 28;
(b)
responsibility of the State for remediation under section 29 (except where
provision is made to the contrary in section 26(2)(b) and 27(1)(d));
(c)
responsibility for remediation being transferred under section 30(1)(a); and
(d) a
decision made under section 54.
