COMMUNITY PROTECTION (OFFENDER REPORTING) ACT 2004 - SECT 97
97 . Fixing a hearing
(1) When an
application for the variation or revocation of a child protection order is
made by a reportable offender, the registrar must —
(a) fix
a day, time and place for a hearing at which the court will consider whether
to grant leave for the reportable offender to continue the application; and
(b)
notify the applicant of the hearing.
(2) The hearing in
relation to the granting of leave must be held in the absence of the
Commissioner.
(3) When an
application for the variation or revocation of a child protection order is
made by the Commissioner, or a reportable offender has been granted leave to
continue such an application, the registrar must —
(a) fix
a day, time and place for the hearing; and
(b)
prepare a summons in the prescribed form; and
(c)
cause the summons to be served on the respondent; and
(d)
notify the applicant of the hearing.
