Western Australian Consolidated Acts (1) A court that
dismisses a charge for want of prosecution —
(a) must
not determine the charge; and
(b) may
discharge the accused from the charge.
(2) The dismissal of a
charge for want of prosecution does not operate as an acquittal of the accused
of the charge.
(3) The dismissal of
an indictable charge for want of prosecution does not affect the operation of
Part 4 Division 2.
