CIVIL LIABILITY ACT 2002 - SECT 10A
10A . Tariffs for damages for non-pecuniary loss
(1) In determining
damages for non-pecuniary loss, a court may refer to earlier decisions of that
or other courts for the purpose of establishing the appropriate award in the
proceedings.
(2) For that purpose,
the parties to the proceedings or their counsel may bring the court’s
attention to awards of damages for non-pecuniary loss in those earlier
decisions.
(3) This section does
not alter the rules for the determination of other damages.
